New Borrower Type: Non-Title Spouse, Part II

To complement our prior article, we're providing a state-specific summary matrix of the following topics: homestead rights, community property rights, and when a Non-Title Spouse's ("NTS'") signature may be appropriate. Once the NTS Borrower Type is selected in DocMagic, the security instrument will have a signature line for the NTS. The note will not contain the NTS' signature as the NTS is not a borrower. (If he/she were a borrower but not on title, then the appropriate borrower type is Co-Signer.) The Notice of Right to Cancel will not contain the NTS' signature (for more information, click here).

Examples of other documents that could but are not required to have the NTS signature line are:

  1. Customer Identification Verification (CIV.MSC)
  2. Important Information - Customer Identification Verification (IICIV.MSC)
  3. Occupancy and Financial Status Affidavit (OFSA.MSC)
  4. Signature Affidavit and AKA Statement (AKA.LSR)
