In response to numerous customer requests, DocMagic has added the following language immediately after the Borrower signature lines of its Fannie Mae/Freddie Mac multistate fixed rate note if the security property is located in Louisiana:
‘NE VARIETUR' for identification with an Act of Mortgage passed before me this
____________ day of __________________, _____.
_____________________________________________________

Paragraph 5 of Fannie Mae's Document Summary for its Multistate Fixed Rate Note (Form 3200) authorizes, but does not require, the above language necessitating the notary public's signature on the note.
"Ne Varietur" is a Latin phrase meaning "it must not be altered." When the notary public officially signs the note, he/she certifies its genuineness. By officially signing the note ‘ne varietur,' the notary binds and identifies the note with the act of mortgage.
Effective on February 20, 2007, the above language will default on all Fannie Mae/Freddie Mac fixed rate notes where the security property is located in Louisiana. If you wish to use the multistate note omitting this language, please contact Customer Service at (800) 649-1362.
