On December 1, 2009, the Board of Governors of the Federal Reserve System, Commodity Futures Trading Commission, Federal Deposit Insurance Corporation, Federal Trade Commission, National Credit Union Administration, Office of the Comptroller of the Currency, Office of Thrift Supervision, and Securities and Exchange Commission jointly amended their privacy rules under Title V of the Gramm-Leach-Bliley Act ("GLBA"). Under the GLBA, institutions must notify consumers of their information-sharing practices and of their right to opt out of certain sharing practices. The revised rules added model notices that provide safe harbor protection in that financial institutions that use the model privacy notices will be deemed to satisfy the disclosure requirements for giving notices under the GLBA. DocMagic, Inc.'s Legal and Compliance Department elected originally not to offer the model forms, because it determined that its customers would not use the model forms; rather, its customers would provide their own privacy notices due to their own policies regarding information sharing practices, including how their consumers' personal information is shared with affiliates. However, as a number of DocMagic customers have been adding the model privacy notices to their document packages, DocMagic is now offering the model forms that its customers can use "as is" or as a starting point for customization of its own privacy notices.
