New York Legislates New Remote Notarization Rules

The New York legislature recently passed, and the governor approved, a new law that authorizes use of remote notarization technology in the state.   Senate Bill 1780 was passed and signed by the governor on December 22, 2021.  The law will be effective 180 days later, expected to be June 20, 2022.

The new law authorizes existing notaries to register to use remote communication technology to complete electronic notarizations.  The secretary of state must create new regulations governing the security of such communication technology as well as standards for the notary’s electronic signature.

The New York remote notary law will require that any remote notary must be within the state when completing a notarial act, though the signers may be out of state.  Notaries completing electronic notarizations with the use of communication technology (remote notarization) will be required to keep a copy of the recording of such notarizations for not less than 10 years.
