California Attorney General Publishes Third Modification to CCPA Rules

The California Attorney General recently published a third set of modifications to the regulations under the California Consumer Privacy Act which became effective earlier this year.  The AG’s regulations originally became effective July 1, 2020, the first date of allowed enforcement under the statute.  The most recently published rules modify the regulations that became final August 14, 2020.

The recent modifications include:

  • New examples for providing the notice of right to opt-out to customers from whom a business collects personal information offline.
  • Guidance for providing methods to opt out that are easy and require minimal steps for a consumer.
  • Clarification on the proof that may be required of an authorized agent to verify a request.
  • Clarification on requirements for disclosure of certain provisions in a company’s privacy policy.

The modifications, including the notice, and a comparison to the existing regulations are available at the California AG’s office website: https://www.oag.ca.gov/privacy/ccpa/current
