Update to DC Deed of Trust Uniform Instrument

Fannie Mae and Freddie Mac recently published a revision to the District of Columbia Deed of Trust uniform instrument.  The update includes a change to the language in Section 26(a) Notice of Default, under non-uniform covenants, Section 26. Acceleration; Remedies.

Fannie Mae and Freddie Mac stated that the update to Section 26 (a) Notice of Default was done to “provide more clarity.”  Two notable changes were made to the list of items that must be specified in a Notice of Default. Item (v) was expanded to read “Borrower’s right to participate in pre-foreclosure mediation and the instructions Borrower must follow in order to participate in pre-foreclosure mediation.” The last item, “(vii) any other information required by Applicable Law” was removed as repetitive. 

In addition to the Section 26 update, the District of Columbia Deed of Trust tagline in the footer has been updated to show a version date of (Form 3009 07/2021 (rev. 06/23)).

Accordingly, DocMagic will be updating all District of Columbia Deed of Trust forms, including FHA and VA versions that follow the uniform instrument,  to include the revised language and updated tagline in the footer.  The updated forms will be available in production as of July 13, 2023.
